Give me two reasons why Supreme Court Justices should be included under these rules. Then give me two reasons why we should NOT specifically apply these rules to Supreme Court justices.
The following Canons are from the Federal Code of Ethics as established by the American Bar Association.
These Canons apply to all federal judges EXCEPT the Supreme Court. Read below:
“Canon 1: A Judge Should Uphold the Integrity and Independence of the Judiciary
Canon 2: A Judge Should Avoid Impropriety and the Appearance of Impropriety in All Activities
Canon 3: A Judge Should Perform the Duties of the Office Fairly, Impartially and Diligently
Canon 4: A Judge May Engage in Extrajudicial Activities that are Consistent with the Obligations of Judicial Office
Canon 5: A Judge Should Refrain from Political Activity”
Taken together, the ABA Model Code and the Code of Conduct for United States Judges ensure that virtually every individual serving as a judge in this country is held accountable to a basic code of conduct. The glaring exception is the nine justices of the Supreme Court.
So let’s talk about the two sides of this argument.
Give me two reasons why Supreme Court Justices should be included under these rules.
Then give me two reasons why we should NOT specifically apply these rules to Supreme Court justices. You’ll need to do some research. There are definitely arguments on both sides. Supreme Court Chief Justice John Roberts has not, thus far, chosen to extend these rules to the Supreme court. So there are definitely arguments that are legitimate on both sides.
